By accessing or using the Poseidon Giveaways website (poseidongiveaways.com) and participating in any giveaway promotion, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services or enter any giveaways.

2. Eligibility

To participate in Poseidon Giveaways, you must:

• Be at least 18 years of age
• Be a legal resident of the United States (unless otherwise specified for a specific giveaway)
• Provide a valid email address
• Not be an employee, officer, or contractor of Poseidon Brand or its affiliated companies

Individual giveaways may have additional eligibility requirements, which will be specified on the respective giveaway page.

3. How to Enter

No purchase is necessary to enter any giveaway. To enter:

• Visit the specific giveaway page
• Complete the entry form with your full name, email address, and optionally your phone number
• Verify your email address via the confirmation link sent to you
• Limit one entry per person per giveaway (determined by email address)

Automated entries, bulk entries, entries submitted by third parties, or any other attempt to submit multiple entries will be disqualified.

4. Winner Selection

Winners are selected randomly from all eligible, verified entries after the giveaway deadline. The selection process is conducted by Poseidon Giveaways administrators. Winners will be notified via the contact method specified for each giveaway (email and/or SMS). If a winner does not respond within 14 days of notification, an alternate winner may be selected.

5. Prizes

Prize details, including description and approximate retail value, are listed on each giveaway page. Please note:

• Prizes are non-transferable and cannot be exchanged for cash (unless the prize is cash)
• Prize images are for illustration purposes; actual prizes may vary
• Winners are solely responsible for any applicable taxes, fees, or other costs associated with prize acceptance
• Poseidon Giveaways reserves the right to substitute a prize of equal or greater value

6. SMS Communications

By providing your phone number, you consent to receive transactional SMS messages related to your giveaway participation. Key details:

• Messages may include entry confirmations and winner notifications
• Message frequency varies; typically 1-3 messages per giveaway entered
• Message and data rates may apply
• Reply STOP to opt out of SMS messages at any time
• Reply HELP for assistance
• Supported carriers include all major US carriers

Providing a phone number is optional and not required to enter giveaways. SMS consent is not a condition of entry or purchase.

7. User Conduct

You agree not to:

• Submit false or misleading information
• Use automated tools, bots, or scripts to enter giveaways
• Attempt to circumvent entry limits or rate limiting
• Interfere with the operation of the website or any giveaway
• Engage in any activity that violates applicable laws

Violation of these rules may result in disqualification and a ban from future giveaways.

To the fullest extent permitted by law, Poseidon Brand shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or participation in any giveaway. Our total liability shall not exceed the value of the prize associated with the relevant giveaway.

10. Indemnification

You agree to indemnify and hold harmless Poseidon Brand, its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from your violation of these terms or your participation in any giveaway.

11. Modifications

We reserve the right to modify, suspend, or cancel any giveaway at any time for any reason, including but not limited to technical issues, fraud, or force majeure events. We may also update these Terms of Service at any time. Continued use of our services constitutes acceptance of any changes.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the State of California.
